see now that was dumb, yong, and i'll tell you why. that cop could have arrested him for saying that on some kind of grounds such as 'hostile behavior toward law enforcement' or some such similar statute. what would have followed would have been an enormous inconvenience for that dude. he'd be arrested, booked, and jailed. then he'd either put up bond to get out of jail, or sit in jail until the prosecutor got to his case and reviewed the charges... which would take weeks or months depending on how backed up the district attorneys office is. eventually the prosecutor would dismiss the charges... but that dude would not be reimbursed for any time he lost sitting in jail, or for the money he put up to make his bond if he bonded out.
so in the end, that dude would have suffered a big ass headache just to be able to say something tough to a cop on camera. amateur stuff, yong, and not worth the consequences that could have resulted.
and shit like that happens all the time. a cop will deliberately misinterpret a statute, claiming to 'believe' the suspect's actions were an instance of committing said offense, write up the arrest report and take the dude to jail. when the prosecutor's office reviews the arrest report, it'll be thrown out. nine times out of ten the cop knew that would happen, knew the charge was bogus, but arrested him anyway to either a) create an inconvenience to spite the dude, or b) reach a quota of some kind, or both.
